Terms and Conditions

1 Definitions

‘SLCD’ is Scandinavian Log Cabins Direct Ltd., trading at the address shown below.

‘The buyer’ is the person or company buying products from SLCD.

‘Goods’ refers to all products purchased by the buyer from SLCD.

‘Services’ refers to any services purchased by the buyer from SLCD.

2 Acceptance

This agreement applies to the advertisement, sale and service of all products offered by SLCD.

3 Prices

All quotations, price lists, delivery descriptions and publicity material are indicative only until confirmed in writing at the moment of purchase.

4 Payment terms

Unless agreed separately payment terms are as stated on the invoice. The buyer is not entitled to withhold monies or exercise any lien from payments due.

5 Delivery

The delivery period stated is approximate. The goods remain at risk to SLCD until delivery. Title to the goods passes on full payment. SLCD retains the right to recover goods belonging to them and to enter the buyer’s premises to do so.

6 Acceptance

The goods must be inspected within 7 days of receipt and any missing items reported immediately. If any goods are returned these must be in original condition and suitably packaged. Return costs to be borne by the buyer.

7 Warranty

SLCD guarantees that the goods supplied will be free from defects for 12 months from receipt of order. Should any defects arise, SLCD will replace the faulty parts within a reasonable time. The following situations are specifically excluded from this guarantee:

1. Damage caused by incorrect storage, installation, use, modification or repair not authorised by SLCD

2. Damage howsoever caused

3. Wear and tear

4. Fitness for purpose

5. 3^rd party products guaranteed by subcontractors

8 Services

Where included in the delivery SLCD will not be liable for provision:

1. Outside normal working hours, weekends or public holidays

2. For changes requested by the buyer

3. For maintenance

SLCD reserve the right to nominate subcontractors.

9 Custom design

Where requested all efforts will be made to meet any changes to the standard design. SLCD reserve the right to have the final decision regarding the suitability and extent of these changes

10 Liability

SLCD accept liability for any private property loss or damage, death or personal injury caused by the negligence of person or persons employed by them. Except for death or personal injury this is limited to the contract value. No liability will be accepted for:

1. Losses incurred through the use of the goods.

2. Consequential loss through any failure to fulfil this contract.

3. Costs incurred prior to repair/replacement under guarantee

4. Theft

11 Intellectual property ‘IP’

SLCD indemnifies you from all costs arising from claims that their products infringe the IP of any 3^rd party. Where such a claim arises, SLCD reserve the right to make modifications and/or substitutions at their cost so as to comply with any settlements. The buyer agrees to co-operate in any such claims by a third party.

12 Exportation

The goods are subject to the export control laws of Sweden and the buyer agrees to comply with these at all times including subsequent disposal of the goods.

13 Force Majeure

SLCD are not responsible for any failure to deliver caused by circumstances beyond their control including (but not limited to) strikes, terrorism, war, weather conditions, exchange fluctuations, governmental or regulatory changes and natural disasters.

14 Confidentiality

Both parties must treat all information supplied as confidential and not disclose to third parties without prior consent.

15 Termination

SLCD may terminate this agreement at any time providing notice is given in writing and all monies due are returned. Should the buyer wish to cancel this agreement SLCD reserve the right to withhold all costs incurred to date in the fulfilment of this contract.

16 Obligations

The buyer is responsible for:

1. Selection of product and its suitability for purpose.

2. Following instructions provided by SLCD.

3. Materials not included in the delivery.

4. Unless agreed elsewhere foundations, erection, supply & installation of utilities, furniture, decoration.

5. Application for all permissions necessary for compliance with planning, building regulations and any other applicable legislation.

6. Co-operation with SLCD to enable them to carry out their obligations.

7. Indemnification of SLCD against claims arising from 3^rd parties in respect of goods supplied.

8. Keeping goods stored separately.

17 Data protection

Your data will be held in accordance with all applicable legislation

18 Consumer rights

These terms and conditions do not affect your rights under the consumer protection act

19 Jurisdiction

The laws of England will apply to this agreement

20 Miscellaneous

If any part of this agreement is overturned by law the remainder of the contract remains in force.

SLCD reserve the right to subcontract, assign, or transfer its obligations or rights under this contract to any third party whether whole or in part.

The goods provided by SLCD are a natural product and as a result slight variations in colour, size and weight may occur from time to time. SLCD will endeavour to keep these variations within limits but cannot guarantee continuity between batches of products as such.

Each order received by SLCD will be deemed to form a separate contract.
